If you’ve been following the news in our industry lately, you know it can feel like a roller coaster.

In our world, a small piece of news or a "likely" outcome can get sucked into the industry echo chamber. Before you know it, rumors are spreading like wildfire, and speculation is being treated as a done deal.

We want to help you decode the noise. Our goal is to be your source for facts—not "what-ifs." Here is the reality of where things stand today:

There’s been a lot of movement, and even more chatter, in our industry lately, so we want to keep you in the loop.

⚠️ HB4759: Kentucky Copy-Paste

Originally, this bill was better than HB4758 but it was killed on the House floor last Wednesday. So there will be no more movement here. The focus is now on HB4758.
 

🛑 HB4758: The Full Ban - But Now Amended

This bill, as it was originally written, was obviously very bad as it was a full ban. BUT there was an amendment proposed by Representative Gatch and Ford that offers comprehensive regulations. It offers consumer safety like age restrictions, but also allows brands like Rebel Rabbit to continue selling MOST of its products. 
 
The House calendar is not yet set, but they will likely meet again on Tuesday or Wednesday this week for a floor vote. We encourage all South Carolinians to call your local representative in support of the Gatch/Ford Amendment to HB4758.
 

✅ H.3924: The Bill We’re Backing

Already introduced in the Senate, this bill offers a more practical, consumer-friendly option:
  • 5mg beverages sold anywhere with a beer/wine license
  • 10mg cans and 10mg/shot bottles (750ml) allowed in packaged liquor stores
  • Keeps Rebel Rabbit’s Spirit Bottle legal
  • Creates a structured, responsible path forward
On February 11, the Senate subcommittee meets (hopefully for the last time) to discuss final amendments. If passed, H.3924 moves to full committee—then it’s back to the House.
 

The Bottom Line

We’re in a critical moment. If HB4758 passes as-is, then we will have our work cut out for us heading into the Senate. However, if the Gatch/Ford Amendment passes, we will have a much better starting point with the Senate. 
 
For H.3924, while the language is not perfect, it is a great starting point. Wednesday's subcommittee meeting will tell us more once we hear any proposed amendments.

While the rumors spin online, the real work is happening in person. On Wednesday, Jan 14th, our leadership team was in Columbia for a Senate Judiciary Subcommittee meeting.
South Carolina is our home, and we aren't leaving our future to chance. We are speaking directly to the subcommittee to ensure they understand:

  • The Solution: We are pushing for smart regulation and fair taxation, not bans.
  • The Standard: We advocate for strict manufacturing processes and keeping products out of the hands of children.
